2. Scope
2.1. These general terms and conditions of sale (the "Terms") apply to any order placed on the website www.ipurple.eu by a natural person acting as a consumer (the "Customer").
2.2. iPurple SRL may amend these Terms at any time. The applicable Terms are those in force on the date the order is confirmed; this confirmation constitutes full and unreserved acceptance of the Terms.
2.3. Professional (B2B) orders: these Terms govern sales to consumers. Orders placed by a professional acting in the course of their business are handled on a case-by-case basis, by written arrangement; the right of withdrawal set out in Article 7 does not apply to such orders.
3. Products
3.1. Offer
The products offered are those available at the time of the order. iPurple SRL may add, modify or remove products at any time. Products are presented as accurately as possible. The colour shown on screen may differ from the actual colour (depending on your screen/browser); iPurple SRL cannot be held liable for such differences or for inaccuracies in the photographs.
3.2. Pre-orders, HOT and Restock
- Pre-order products are shipped to our warehouse after their release date in South Korea. The approximate shipping date from our warehouse is indicated on the product page.
- The "estimated" shipping date shown on the product page (PRE-ORDER, HOT, RESTOCK) is an estimate and not a firm commitment; it may vary.
- Pre-order benefits are only included during the pre-order period, i.e. before the official release date of the item. After the official release date, iPurple SRL reserves the right to no longer include them.
- Products sold with extras (withmuu, soundwave photocards, YG gift, …) usually have a later shipping date than the standard versions.
3.3. Prices
Prices are shown in euros, all taxes included. Delivery costs are not included in the price, unless stated otherwise; they are displayed during the order process. iPurple SRL may change its prices at any time; the applicable price is the one in force when the order is validated.
3.4. Outer case/box (all products)
The outer case/box is simply for protecting the goods. Damages such as scratches or discoloration on the case/box cannot be compensated.
4. Orders
4.1. The Customer adds the products to their basket and can check the details and total of their order before validation. A customer account may be created.
4.2. The order is validated by acceptance of the Terms and by payment. iPurple SRL sends an order confirmation by e-mail as soon as possible (order number, products, place of delivery, etc.); this confirmation constitutes proof of the contractual relationship. iPurple SRL may refuse an order for any legitimate reason (e.g. an unresolved dispute arising from non-payment of a previous order). If a product is unavailable, the Customer is informed by e-mail as soon as possible.
5. Payment
5.1. Payment is made in euros, in full at the time of the order, by card (credit, debit, digital wallet), via PayPal, by bank transfer or by voucher. The order is only processed after payment has been validated.
5.2. Voucher: usable once only, cannot be split and gives no change; it may be combined with another means of payment. Vouchers are valid only for the period initially indicated and cannot be extended. Vouchers are non-refundable.
5.3. Bank transfer: instructions are sent by e-mail; the exact amount must be transferred within five business days. If no payment is made within this period, iPurple SRL may cancel the order.
5.4. Invoicing: an invoice is not provided by default. If an invoice is required, the request must be made by e-mail to [email protected]. The invoicing details reflect those provided by the Customer and cannot be changed after issuance.
6. Delivery
6.1. Delivery is made exclusively via the carriers offered by iPurple SRL: to a pickup point, to an address of your choice (home, workplace), depending on the country of destination. The details (carriers, indicative delivery times, parcel-shop holding period, countries served) are set out on the "Delivery" page of the website.
6.2. Some carriers may deliver the parcel to a nearby pickup point or to a neighbour if no one is present at the given address; iPurple SRL is not responsible for this.
6.3. The delivery times shown at checkout are purely indicative. Delays occurring after dispatch are the carrier's responsibility; iPurple SRL can contact the carrier on your behalf ([email protected]) but does not grant any compensation for delays attributable to carriers.
6.4. Orders are delivered all at once: your entire order is held until all items are in stock. Items within the same order are never shipped separately. Items not yet in stock are marked as pre-order (PRE-ORDER), HOT or RESTOCK, and the approximate in-stock/shipping date is indicated on the product page.
6.5. iPurple SRL fulfils accepted orders as quickly as possible and no later than 30 days, unless another delivery period has been agreed. In the event of a delay or impossibility of fulfilment, the Customer is informed before the expiry of the planned period; failing that, the order may be cancelled free of charge and refunded. An order may be modified or cancelled as long as it has not moved to the "Being prepared" status; after this status, no further modification or cancellation is accepted.
6.6. Orders outside the European Union: customs duties and/or import VAT may apply on receipt and remain the Customer's responsibility.
6.7. Risk: our shipments travel at our risk until delivery to the Customer or to a third party designated by them, including in the case of delivery to a pickup point. The Customer does not bear the loss of a parcel within the postal network. However, if the Customer returns goods under the right of withdrawal, the return transport is their responsibility (see Article 7).
6.8. Damaged or non-conforming parcel: any transport damage, any discrepancy with the delivery note or with the order must be reported within one week of receipt, and the items must be returned within 14 calendar days of the report. iPurple SRL's liability is limited to the value of the items not received. This clause does not affect the legal guarantee of conformity (Article 8) or the right of withdrawal (Article 7).
6.9. Refused or unclaimed parcels: for parcels refused or not claimed by the recipient, only the value of the products, less the shipping costs incurred, will be refunded. The shipping costs incurred - which include both the outbound shipping and the cost of returning the parcel to iPurple SRL - are at the Customer's expense.
7. Right of withdrawal
7.1. The Customer has 30 days from receipt of the goods to withdraw, without penalty and without giving any reason.
7.2. To exercise this right, the Customer notifies their decision by an unambiguous statement, by e-mail to [email protected], stating: their name, their address, the order number, the order or receipt date, and an explicit statement that they are withdrawing from the sale of the goods concerned.
7.3. Refund: iPurple SRL refunds the Customer within 14 days, using the same means of payment. The refund is made only after receipt of the returned goods and verification of their conformity (items still sealed if they were originally sealed, complete and undamaged). Failing this, iPurple SRL may refuse the return or make only a partial refund (see Article 7.6).
7.4. During the withdrawal period, the Customer handles the goods and packaging with care and only uses them to the extent necessary to assess whether they wish to keep them. The return must be made in the original packaging, with all accessories, in original condition. Sealed items must be returned still sealed.
7.5. Exclusions from the right of withdrawal (Article VI.53 of the Belgian Code of Economic Law, transposing Article 16 of Directive 2011/83/EU):
- a) any sealed item that has been unsealed after delivery (in particular albums, CDs/DVDs, other media and any sealed merchandise): an unsealed item can no longer be returned;
- b) cosmetics and other goods which cannot be returned for hygiene or health-protection reasons, once unsealed after delivery;
- c) goods made to order or clearly personalised;
- d) clothing that has been worn, washed or whose original tags have been removed; underwear can only be returned in unopened packaging.
7.6. iPurple SRL may refuse the return or make only a partial refund for goods that are damaged or show signs of use. Any damage on arrival must be reported within one week of receipt (see Article 6.8).
7.7. Gift: if the entire order is returned, any gift must also be returned; failing that, its value is deducted from the refund.
7.8. The delivery note should be included in the return; if no longer possible, a note with the Customer's name, e-mail and order reference is also accepted.
7.9. Return costs: returns due to an error by iPurple SRL (e.g. wrong version) are at our expense. All other return costs are the Customer's responsibility.
8. Legal guarantee of conformity
8.1. Independently of the right of withdrawal, the Customer benefits from the 2-year legal guarantee of conformity provided for by Belgian law (transposing Directive (EU) 2019/771). This guarantee applies to all consumer goods sold by iPurple SRL.
8.2. The guarantee covers lack of conformity (an item that does not match its description, is incomplete or is defective from the outset). It does not cover normal wear and tear, damage caused by the Customer, or a change of mind (see the right of withdrawal, Article 7).
8.3. In the event of a lack of conformity, the Customer is entitled to have the goods brought into conformity (repair or replacement) and, where applicable, to a price reduction or to termination of the sale, under the conditions set by law.
8.4. This legal guarantee is distinct from any commercial guarantee and applies free of charge to the Customer.
9. Personal data
iPurple SRL processes the Customer's personal data in compliance with the GDPR (Regulation (EU) 2016/679), in order to manage orders, answer questions and carry out satisfaction surveys. The Customer has the rights of access, rectification, objection, erasure, restriction and portability, which can be exercised at [email protected]. 10. Intellectual property
Our website, logos, texts, photos, names and all of our communication in general are protected by intellectual property rights (ours, those of our suppliers or other rights holders). Any copying or reproduction (drawings, photographs, texts, logos, colour combinations, etc.) is prohibited without our prior written consent.
11. Limitation of liability
11.1. Use of the website: the user is solely responsible for their browsing. iPurple SRL cannot be held liable for breakdowns, errors or viruses that may affect access to the website, nor for any direct or indirect damage to the user's equipment.
11.2. Force majeure: in the event of force majeure, iPurple SRL is not required to perform its obligations and may either suspend them for the duration of the force majeure or terminate the contract. This includes, in particular: strikes, fire, breakdowns, power or network failures, unavailability of the website, or late delivery by suppliers or other third parties.
12. Miscellaneous
12.1. Evidence: e-mails and automatic recording systems are deemed authentic between the parties, in particular in the context of litigation.
12.2. Partial invalidity: the invalidity of one clause does not affect the validity of the others.
12.3. No waiver: the fact of not requiring the application of a clause does not constitute a waiver of the right to rely on it later.
13. Complaints and disputes
13.1. Any complaint must be sent within one week of delivery to [email protected], with a clear and detailed description. iPurple SRL handles it as soon as possible; if needed, it contacts the carrier concerned.
13.2. Applicable law and courts: these Terms and any order are governed by Belgian law, without prejudice to the mandatory consumer-protection provisions of the country of the Customer's habitual residence (Article 6 of the "Rome I" Regulation). In the event of a dispute, a consumer Customer may bring proceedings, at their choice, before the courts of their place of domicile or the Belgian courts; iPurple SRL may bring proceedings against a consumer Customer only before the courts of the latter's domicile (Regulation (EU) No 1215/2012 "Brussels Ia"). For professional (non-consumer) orders, only the courts of the judicial district of iPurple SRL's registered office have jurisdiction.
13.3. Out-of-court settlement: the Customer may contact the Consumer Mediation Service (Boulevard du Roi Albert II 8 box 1, 1000 Brussels - [email protected] - mediationconsommateur.be) or use the Belmed platform of the FPS Economy. For cross-border disputes within the EU, the Customer may contact the European Consumer Centre (ECC) Belgium.
